Jill B. Rowe

Jill Battilega Rowe is a partner at Cooper, White & Cooper LLP.  She practices general litigation, with an emphasis in contract, real property, fraud, fiduciary duty, securities, professional liability, and pipeline safety disputes.

Ms. Rowe received her juris doctorate with honors from the University of Washington School of Law. She graduated summa cum laude from the University of San Diego, with a bachelor's degree in political science.

Before joining Cooper in 1999, Ms. Rowe worked as in-house counsel for a Fortune 500 company, where she handled mergers and acquisitions, employment and general corporate matters.

Ms. Rowe's community service activities include work with San Francisco's Homeless Advocacy Project, representing litigants in unlawful detainer cases, and mediating small claims disputes.  In 2008, she received an Outstanding Volunteer in Public Service Award for her work with the Volunteer Legal Services Program's Housing Negotiation Project, where she helps mediate disputes between landlords and tenants.

  • Successful defense, through a six-week trial, of a nationally prominent real estate brokerage firm, for alleged intentional fraud, breaches of fiduciary duty, and unfair competition.  The case arose out of five triple net leased investments (retail gasoline stations) and the claims related to alleged misrepresentations of income stream, financial strength of guarantors, and operator track records.  (2007)

  • Successfully defended over a two-year period the nation's largest petroleum pipeline owner in 24 personal injury and wrongful death lawsuits, including cases involving five deaths and four serious burns arising out of a fire and explosion that occurred on a high pressure petroleum line in which failures to locate and mark the line and violations of California's Underground Service Alert statute were alleged. DOT enforcement actions, OSHA citations, California State Fire Marshall investigations, and District Attorney charges were also involved, and over $200 million in damages were claimed.  (2006-2007)

  • Successfully defended attorneys in two separate complex cases involving alleged contempts of court.  (2006-2007)

  • Obtained a judgment in favor of our client after trial in a dispute between two partners arising out of extensive investments in Southern California commercial real property, with cross claims for breach of fiduciary duty, fraud, conversion, accounting, contempt of court, and domestic violence. (2006)

  • Won summary judgment in favor of former lawyer accused of breach of fiduciary duty.  (2006)

  • Successfully defended a nationally prominent winery in resolving claims of TCA contamination and associated product disparagement.  (2005-2006)

  • Won a California Appellate case in a published opinion establishing the right to arbitration by a non-signatory agent to a contract containing an arbitration clause.  (Westra v. Marcus & Millichap, 129 Cal.App.4th 759 (2005)).  (2005)

  • Won dismissal of federal and state False Claims Act claims, based on public disclosure/original source doctrine.  (2005)

  • Won dismissal of a water utility client being sued in a toxic tort case.  (2004)

  • Successfully defended a securities broker and brokerage firm in National Association of Securities Dealers arbitration.  (2004)

  • Obtained summary judgment for a national bank based upon California's full credit bid rule.  (2003)

  • Pierced the corporate veil of a corporation, permitting the client to obtain a large settlement.  (2002)

  • Obtained a restraining order to protect a local television personality who was being threatened by a viewer, resulting in a jail term for the defendant.  (2001)

  • Obtained a defense judgment after a Superior Court trial relating to international finance, and successfully defended the judgment on appeal.  (2000)
