John Epperson is a partner at Cooper, White & Cooper’s San Francisco office. Mr. Epperson has a broad environmental, health and safety law practice. He advises clients regarding a wide range of regulatory compliance counseling, transactional, and permitting issues. He represents clients in enforcement actions by state and federal environmental agencies, investigating alleged violations, defending enforcement actions and advising on corrective action. Mr. Epperson advises clients in their efforts to investigate and remediate contaminated properties, voluntarily or in response to regulatory action, including cost recovery efforts and formation of multi-party response groups. He also advises clients regarding environmental issues in commercial transactions, directing due diligence to identify potential environmental liabilities and developing mechanisms to allocate these risks and protect the client. This includes experience with due diligence for renewable energy projects.
Mr. Epperson has extensive experience with counseling clients regarding compliance with a wide variety of state and federal environmental, health and safety laws and regulations, including the many such rules that apply to use of hazardous substances and waste; the Clean Water Act (including stormwater and citizen suits), RCRA, CERCLA and their state law equivalents; California’s Proposition 65; pipeline safety; radioactive materials; and federal and state OSHA(s). He has assisted with accident investigations, including employee fatalities and related OSHA investigations. He also has experience advising clients regarding compliance with the California Environmental Quality Act (CEQA) and the National Environmental Policy Act, triggered by seeking and obtaining approvals and entitlements for changes in land use.
Mr. Epperson has spoken on a variety of environmental topics to industry groups and environmental attorneys and is an adjunct professor teaching a class at Golden Gate University on “Toxics and Brownfield Law”. He is a former member of the Executive Committee of the California State Bar Environmental Law Section and currently serves as an Advisor and co-chair of the Section’s Legislation Committee. He is also a former Committee Vice-Chair for the ABA Superfund and Natural Resource Damages Litigation Committee. Prior to joining Cooper, White & Cooper, Mr. Epperson was Special Counsel at Farella, Braun and Martel, an associate at LeBoeuf, Lamb, Green and MacRae, and contract attorney at San Diego Gas & Electric. Prior to entering law school, Mr. Epperson had over ten years’ experience in radiation safety and emergency planning working as a Health Physicist in the nuclear power industry
